Terms of Service

Guidelines, unacceptable use restrictions, and service level conditions

1. Acceptance of Terms

By accessing or using the LinWin Cloud automated deployment platform, API endpoints, or client management dashboard ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use our Service.

2. Nature of the Service

LinWin provides automated scripts and kexec in-memory virtualization tooling designed to stream customized operating system images onto user-owned or rented Kernel-based Virtual Machine (KVM) servers. Users are solely responsible for ensuring they have valid administrative authorization over target servers before executing any LinWin deployment script.

3. Account Responsibilities & Security

You are responsible for safeguarding your account credentials, API tokens, and remote desktop passwords generated during deployments. You agree not to disclose your API tokens to unauthorized third parties. LinWin is not liable for unauthorized access resulting from your failure to secure your credentials.

4. Acceptable Use Policy (AUP)

You agree NOT to use the Service or deploy operating systems for any unlawful or prohibited activity, including but not limited to:

  • Denial of Service (DoS/DDoS) attacks, network flooding, or packet spoofing.
  • Unsolicited bulk email delivery (SPAM) or hosting open mail relays.
  • Cryptocurrency mining that violates your underlying VPS hosting provider's Terms of Service.
  • Distribution of malware, ransomware, botnets, or illegal copyrighted materials.
  • Port scanning or unauthorized penetration testing without explicit written authorization.
  • Any violation of this Acceptable Use Policy may result in immediate account termination without refund and revocation of all unused deployment credits.

    5. Microsoft Licensing & "Bring Your Own License" (BYOL)

    LinWin provides bare-metal and VirtIO-optimized OS images strictly on a Bring Your Own License (BYOL) basis. LinWin does not sell, bundle, or distribute Microsoft Windows license keys. Users must supply their own legitimate digital license or Volume Activation Services (KMS/MAK) key in compliance with Microsoft licensing guidelines.

    6. Limitation of Liability & Data Loss Warning

    AUTOMATED OS INSTALLATIONS PERMANENTLY ERASE ALL EXISTING DATA ON THE TARGET DISK DEVICE.

    You acknowledge that executing a LinWin script performs raw block-level writes to the selected target storage drive. Under no circumstances shall LinWin, its maintainers, or affiliates be held liable for any loss of data, loss of business revenue, server hardware failure, or service downtime arising from the use of our automated deployment scripts.
